Anthropic received the official written designation from the Department of Defense on March 4, formally classifying the company as a national security supply chain risk — the first time the designation has been applied to a US-based company. Previously, the supply chain risk framework was used exclusively against foreign adversaries, notably Huawei and ZTE. Under the designation, all US defence contractors are required to certify that they are not using Claude across their operations. Anthropic stated it considers the designation "legally unsound" and began preparing a legal challenge.
What the designation covers — and what it does not
- Scope: applies only to direct Department of Defense contracts and contractors — companies subject to DoD procurement rules must certify non-use
- Not affected: all commercial enterprise customers using Claude via Microsoft Azure, Google Cloud, Amazon Bedrock, or directly through the Anthropic API are unaffected
- Not affected: Claude.ai consumer subscriptions, Claude Code, Cowork, and all non-defence government agencies are outside the scope of the designation
- Anthropic's response: the company has not agreed to the designation, does not accept its legal basis, and is pursuing a formal challenge
For enterprise developers: if your organisation operates within the US defence supply chain, review your compliance obligations under this designation. For all other enterprise use cases — commercial, civilian government, healthcare, finance, technology — there is no change to Claude's availability or terms of service.

The supply chain risk designation framework was originally designed for hardware — routers, semiconductors, and networking equipment from foreign adversaries that could carry embedded backdoors or surveillance capabilities. Applying it to a software AI company is novel and legally untested. The designation functions by requiring government contractors to attest they are not using the named vendor — effectively a blacklist within the procurement ecosystem. The mechanism has no precedent in software, let alone AI, which makes the Anthropic case a potential landmark for how governments can regulate AI adoption in defence contexts globally.
Why this case is different from hardware supply chain cases
- Hardware supply chain risks involve physical components that can be inspected and replaced; AI model behaviour is defined by training, not by physical modification
- The stated concern is not a security vulnerability but a policy disagreement — the designation applies because Claude's safety policies are characterised as operationally inconvenient, not because Claude has been compromised
- The precedent: if safety documentation can trigger a supply chain risk designation, every AI company faces a structural incentive to remove or weaken public safety commitments to remain government-eligible
- Anthropic's lawsuit, when filed, will test whether the First Amendment protects a company's published policy documents from being used as grounds for government sanction
